TERMS OF SERVICE (ToS)

1. ACCEPTANCE OF TERMS

By purchasing, installing, or using HydroDefend products and services ("The Service"), you agree to be bound by these Terms. If you do not agree, do not initialize the system.

2. SERVICE SCOPE

HydroDefend provides water leak detection hardware, professional installation, and monitoring capabilities.

  • Not an Insurance Company: HydroDefend is a risk mitigation technology provider. We are not an insurer. We do not guarantee that water damage will never occur.

  • System Limitations: You acknowledge that the System relies on technology that may be subject to failure due to power outages, internet service provider (ISP) outages, battery depletion, component failure, or "Force Majeure" events.

3. CUSTOMER RESPONSIBILITIES

To ensure the Defense Grid functions correctly, the Customer agrees to:

  • Connectivity: Maintain an active Wi-Fi connection and Power Supply (for Tier I, II, and III systems). HydroDefend is not responsible for failures caused by ISP outages.

  • Maintenance: Replace batteries in sensors and hubs upon receiving a "Low Battery" notification.

  • Access: Grant HydroDefend technicians reasonable access to the property for installation and warranty service.

  • Testing: Perform a system test (as outlined in the User Manual) at least once every 6 months.

4. LIMITATION OF LIABILITY (CRITICAL CLAUSE)

READ CAREFULLY: TO THE MAXIMUM EXTENT PERMITTED BY COLORADO LAW, HYDRODEFEND SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • WATER DAMAGE: REPAIR COSTS FOR DRYWALL, FLOORING, PERSONAL PROPERTY, OR MOLD REMEDIATION.

  • LOSS OF USE: COSTS ASSOCIATED WITH TEMPORARY HOUSING OR BUSINESS INTERRUPTION.

OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THE SERVICE SHALL BE LIMITED TO THE TOTAL AMOUNT PAID BY YOU TO HYDRODEFEND FOR THE HARDWARE AND INSTALLATION.

Plain Language Summary: If the system fails and your house floods, we will refund you the cost of the system, but we are not paying to rebuild your house. That is what your Homeowner's Insurance is for.

5. WARRANTIES

  • Hardware: HydroDefend passes through the Manufacturer’s Warranty (typically 1-2 years) on all valves and sensors.

  • Labor: HydroDefend provides a 1-Year Workmanship Warranty on the installation. If a leak occurs at the installation point (e.g., the fitting we soldered) within 1 year, we will repair the fitting at no cost.

6. INSURANCE CERTIFICATES

We provide a "Certificate of Active Defense" upon successful installation.

  • No Guarantee of Discount: While many carriers offer discounts for our systems, HydroDefend does not guarantee that your specific insurance carrier will grant a premium reduction. Discount policies are at the sole discretion of the insurer.

7. DISPUTE RESOLUTION

Any dispute arising under these Terms shall be resolved through binding arbitration in Denver, Colorado, in accordance with the rules of the American Arbitration Association.

8. MODIFICATIONS

HydroDefend reserves the right to modify these terms at any time. Continued use of the Service constitutes acceptance of the modified terms.
